There are actions that Nokia can take to cause a delay in the implementation of an exclusion order. Respondents can file motions requesting the ITC and/or CAFC to issue a permanent stay of the order pending a CAFC appeal (seldom granted), or they can file with CAFC for a temporary stay (sometimes granted). In addition, actual implementation of the exclusion order is the responsibility of US Customs, which has its own rules and procedures which must be followed.
