JL, I would agree with you that IF the lawsuit is accepted by a court of law, amrn does have a chance in winning according to your logic and reasoning.

But I am not sure that amrn legal action can even proceed that far.

It seems to me exwannabee is saying the FDA is immune to such legal action by an act of congress.

However, not being a legal person, I have been burned by legal outcomes that go against my common sense when it comes to investing as per my experience with mnta.

The lower DC rules for mnta that amphastar infringed on mnta mfg patent(s) only to be voided by the Appeal Crt according to some legal principles that completely escape me.
