GOOG has to turn over the code or whatever crap it is that makes New AdWords work to VRNG by August 25th. Once VRNG gets whatever programming stuff it is that makes this thing work, then it is VRNG's burden of proof to prove that New AdWords is no more than "Colorably Different" from the patents in suit that GOOG has already been found to be infringing upon. Upon showing that, the burden returns to GOOG to prove that is IS MORE than "Colorably Different" and not infringing.

Just as in trial the Plaintiff puts on their case first as the burden of proof is upon them. Then, the Defendant puts on his defense. HJJ will then decide whether or not VRNG has met its burden of proof and whether or not the work around is only "Colorably Different," or not.
