i think the issue is, its being spun as though google doesn't have to provide evidence of it. clearly google must provide documentation, evidence, and expert witnesses. this is effectively having to prove it. vrng can then rebut and that is their proof that a workaround is not colorably different. its semantics but end of the day, google must provide evidence is the key here
