OK, so right now, the defendants can sign a license agreement with Interdigital which would include the infrastructure portfolio. It would include flexible ways to approach a settlement such as Smart Access Manager, Convida Wireless, partnerships, patents, etc. The question is, are the patents in suit, along with the flexible levers to encourage settlement strong enough for the defendants to see the advantage of resolving this prior to the FD? If IDCC wins the 800 FD, will IDCC be as flexible? Hopefully the patents and outside levers are strong enough to resolve these disputes prior to 10/28, so that IDCC does not have to face the possibility of a defeat in the 800? Meanwhile, where in the hell is the 613?
