It can tho, as long as they put a "TD" after the logo it means it has been registered bu the USPTO and may carry on with business. Just like u may see "patent pending" on things. Once the trademark has been registered they can put "R" after the logo. If it fails registration and gets denied it gets settled in court, but u dont hold up business because of the USPTO, it has the time and date it was in and u are first. That is the only real reason for the USPTO, record time and date.
