Thought I'd chime in here. I've been reluctant with this company despite believing in their patent portfolio for a number of reasons including the skeletons in the closets of the current and prior execs. They speak volumes for the character of those in charge, and it's suspect of course, but on the flip side most companies that have anything of value are sued from time to time. It's part of the cost of business, and my .02 on this is that because this suit is quite old and quite irrelevant, I wouldn't put much thought into it other than a small distraction. And any personal suit for an ex employee has even less bearing on the company.

I think that now the Digifonica agreement is completely finalized that it's smoother sailing, and any potential buyer of these patents could take care of this tiny court issue easily, as it has no bearing on what patents are worth, which ones are granted issue, etc.

Setting aside old non-consequential issues the facts are:
Lawful intercept AND enhanced 911 now issued.
Other patents pending look favorable based on progression through USPTO when compared to the two that are issued at this point.
Digifonica and Voip=Pal are legally one in the same and all Digifonica stock converted to VPLM shares.
Any buyer must go through Voip=Pal period.
The IP is quite valuable as anyone following the company can assume.
It is more valuable by far, than .07 X 586,038,000 outstanding shares, in my opinion.

Based on the above I am feeling that this company has tremendous upside now that the questions with Digifonica are answered.
