First off I'm not a lawyer:
The fact that the government allowed shares to continually be traded and in existence for about 5 years displayed the idea that the shares will continue to exist and have value. A reasonable person would have believed that the shares will some day have value based on the governments actions.
The government never said they would liquidate or cancel any of these shares. That has only been media.
Based on the governments actions, I don't see anyway one could even argue to eliminate shares after a return to profitability.
