TD, That is exactly how I read it as well. IDCC rates offered are apparently FRAND or lower, verified by the staff attorney in the current ITC action. The decision today seems to try to end "captive" type price negotiations from a patent holder with an exclusion order. Without offering a fair price prior to the exclusion order, the court wants to eliminate the possibility of holding an infringer hostage to a high price for a license. Not similar to our case, infringers refuse to even pay FRAND.
