I think he will set the RR based upon the evidence. If there is a work around there will be a time for consideration and determination of it. I don't think this is it. That matter should be severed and decided separately from the issues relating to the trial, if the work around is even properly before the Court now insofar as a request for relief. The Court needs to get the trial over and done with, and the remaining 3 motions before the Court are ripe for his ruling. The work around can be addressed another day and the ruling on the RR can be made RIGHT NOW. I think that is what he will do, but only my guess.
