You guys are mixing up a trademark with a trade secret.

The downside of a patent vs trade secret is the patent will expose Indigo. This would make it easier to reverse engineer. Some tweaks of the formula could result in a comparable product. Or a company in China will rip it off altogether, they don't care about patents.

If the material is so unique there is no other like it then treating it as a "trade secret" could be a pretty damn smart move. Google went with the trade secret approach with their search engine algorithm. That is their "Indigo." That algorithm is worth billions. When Lightwave gets bought out the lifespan of their patents play a key role in the valuation. By treating Indigo like a trade secret the life of it's proprietary use becomes potentially infinite and could be considerably more valuable.

I wrote this move off as someone who knows more than I do using good judgement.
