While I can understand your reasoning for your conclusion, I diagree regarding this particular investigation. The ITC will never have a better set of facts regarding the behavior of the respondent in recommending a ban as a result of a final determination of infringement. This is the 337 investigation to put on your knee as the poster boy of a foreign company scheming over a period of 14 years to use the IPR of an Ameican company to further its gain. This company was given access to the labs and libraries of the complaining American company for a period of 3 years during the formative stages of 3g technology. This foreign company has led the world in terminal sales for many of these 14 years. The American company has received nothing for its 3g IPR from the foreign company who licensed the entire portfolio 14 years ago. In fact, the foreign company repudiated the license after 7 years of stonewalling under the guise of good faith negotiating of royalty owed. They have remained unlicensed since that time and have attacked the portfolio in England and the USA. This foreign company has engaged in a textbook definition of willful and wanton infringement and the American company has been irreparably harmed by the actions of said company and other foreign companies who have chosen to follow its lead. If a ban is not the proper remedy in this 337 investigation, the ITC doors should be closed and the millions of dollars spent by American companies in legal fees in using this venue should be reimbursed by the US government to the American inventors. It is time to recognize that the American inventors are far more valuable to the citizens than the tassletoed lobbyists that have moved into our nation's governing institutions.
