The FDA isn't racing to file a response to the IND because some investors are anxious and want an answer. Like every other thing you apply for in life, it takes time and those guidelines are there to provide you with an approximate time frame. Don't even expect the IND news to come out on the 5th, it could come out later than that. We just have to be patient. If you're in you're in, if you're out you're out.
