IDCC believes that Nok cannot maintain its action in DE because of the many reasons discussed in its motion to dismiss. The big difference is the licensee status because the USA would prohibit Nok as a licensee from making a challenge and the UK will allow it because of the language contained in the license. The other difference is that the USA will not allow piecemeal challenges and the UK apparently does.
