Shapiro and PFE counsel signed a consent to adjourn until 4/5/13 and Shapiro has opposition papers returnable by 4/4/13, so we can certainly expect Shapiro to file papers seeking to toss the motion to dismiss. I cannot see a judge granting PFE's counsel motion (although stranger things have happened), but if just seems to complex to summarily dismiss this type of case. To get a summary judgment motion dismissed, the facts must be beyond dispute. As it is, the contractual terms would likely be subject to very different interpretations and litigation would be the only way to clarify both parties interpretations - just my very humble 2 cents.
