UK trial

Got there about 10.40 am; trial had started. Acoustics were terrible and I only heard about 30% of the questions. There were about 20 in the court; mainly attorneys. Probably only me as observer. A young court usher was sleeping.

An American lady was on the stand; probably an employee of IMM in 1990. She was being questioned about a Proprietary Information Agreement from 1990 probably about Pac Bell! NOK's attorney was implying that something was missing from the files. The judge was not impressed. Later the issue turned to Pac NW Bell and trials of the Ultraphone at 3 customers.

After the witness was dismissed, a document (about 15-20 pages) was handed to NOK's lead attorney - which he and the judge hadn't seen earlier. This caused quite a fuss and the court went into recess to study it.

I understood it to be the minutes of an International Telecoms Committee sub-group in 1999. I could see a lot of redacted sections. Whatever it was, it had been introduced suddenly by IDCC but it wasn't clear if they had just received it.

Just before the recess, the judge asked IDCC to confirm a statement that it had made earlier (possibly the previous day) that its patent claims were valid but not necessarily essential. Please note that it was very very difficult to hear this exchange and my understanding may not be correct but I did see the video transcript briefly.

I had to leave (after 45 minutes in total) and will not be able to go back.

Sorry I can't add any more.
All the best,
JK
