Rruff, I agree with many of your points. Shorting ahead of the news of a floorless convertible and/or a private placement is illegal and should be fully prosecuted. I believe that there is more attention being paid to this issue by the federal regulators, so hopefully that can be cleaned up.

I just wish that those who decry shorts and short-sellers as destroyers of companies, would look at the financials FIRST and note that the chances of these stocks surviving as a public entitities were remote at best. Most of the toxic convertibles are issued to companies that have negative cash flow from ops, no earnings, and/or carrying high amounts of debt.
