In light of qcom's recent action against nok, wouldn't it benefit nok to drop the appeal and pay what they felt was a lower rate than idcc wanted, thus establishing some sort of benchmark to take on qcom. Questioning binding arbitration only gives fuel to qcom's complaint and paints nok as a defiant, unwilling to negotiate player in the wireless sector. The US economy depends on protecting its technological edge over the rest of the world and with a foreign company trying to put rate caps on that technology and then using it without paying is not going to fly with the courts in this country. I guess a settlement is just too logical for the finn's to handle.
