You surely must be kidding that they would appoint a new ALJ to reinvestigate. What do you think all these years and hearings have been a practice run? There has been hearings and rulings and all parties have had their say. The CAFC as I understand it makes a final decision and then the remand back is for action to be taken on THEIR DECISON not for a new investigation.

If what you suggest a ITC hearing could go on forever as each decision would have a appeal and then it would be remanded for a new investigation. I find a new investigation would be hard to believe. The ITC made a ruling and the CAFC has made a ruling and I don't think the CAFC is saying now you guys go reinvestigate and see if you can overturn our ruling. They spent more than the ususal amount of time to have their ruling stand, and instructed the ITC wuth the information they have to act on it.
