Reference to contract is between dealers and brokers and the creators of the bogus shares. Bcit is not a party to that part of the suit. Darby and Capital Growth are joining in an action with bcit in the claim against thompson/weller/pino and others. The attorney also acts for capital growth and they are paying, with Darby all the expenses for the suit now jointly undertaken .

Pino paid $50,000 against an initial agreement of $2,ooo,ooo. Bcit did not know of Darby existence at that time.

Jay Dewhurst is part of the Thompson group.

I do not really care what they say, there are no forensic facts to support their statements and the suit will make things plain enough. As to what the public think I do not care a damn as long as I can deprive whom I believe are responsible of most of the money they appear to have generated as damages.

As for Joe Poe he came into my life this august in Venice and the result of that is the legal action currently being undertaken.

I would consider it very unlikely that pino will be associated with bcit in the future once settlement and judgement is reached. Having met him now I am sure he has an active future ahead of him, but it will not be with bcit, I just want his money.

as for the lawsuit what do you all expect the defendants(weller/thompson) to do, lie down and die?

Some of the holders of bogus bcit shares are as thick as two planks.

You see Art, I have gotten rich by focusing through all the fog, the innuendo, the disinformation, the lies, on what really matters, guilt and money. The guilty must pay, and pay my company first since we are the biggest single loser.

There is no change at all to the events as originally described by me, the others have to knit a story as they go along, and they are doing that quite well considering the mess they are in. It has actually become quite entertaining.

You may want to file an 8-K on the lawsuit, or at least a PR about the lawsuit with a copy of your initial petition. From what I hear there are people who will be visiting the courthouse there in OK city, and will be getting a physical copy, which you can be sure will be scanned and be out on the internet it short order. You may want to take the opportunity to upstage them and steal their thunder by coming out with some kind of explanation of your plan with the lawsuit, since it will all be out soon enough.

Anyway, that said... I have a few questions regarding all this..

1. The attorneys you're using, DUNN SWANN & CUNNINGHAM, are they in fact Joe Poe or his firm's attorneys, or were they retained by same?

2. The file says the lawsuit is based on "CONTRACT, BREACH OF AGREEMENT - CONTRACT" can you elaborate on what the gist of the breach was here?

3. Do you know if the regulators may still be bringing civil or criminal suits against Pino et al?

4. Does the lawsuit go after more than the frozen money in the accounts at Capital Growth?

5. Are the financials done to get the filings up to date?

6. I understand Weller and Thompson are stonewalling on signing off on this lawsuit, do you have a feel for a timeframe for this suit to be resolved?

7. Can you provide any insight on Jay Dewhurst? I hear that he actually approached you out of the blue in Venice this summer about this mess.

8. Please tell me that Pino and none of these actors will have any role in the company you plan to reverse merge into the BCIT shell.

9. Can you confirm whether or not the 215MM shares at Cap Growth are the only fraudulent shares remaining out there, or if Pino/crew actually had more shares at other brokers?

10. The $50K you initially got as a partial settlement... did you recieve that from Pino or someone named JH Darby?

It seems the plot ever thickens, and getting the feeling this is all coming to a head soon.
