My take has always been that Victory Mark was simply trying to imitate APS. I don't remember ever hearing the name until APS had established itself as THE penny promoter. From the beginning, people confused it with Victory Stocks, which perhaps was the hope of the people who created it.

There were a lot of changed in the promo world when Dan Ryan and PennyStockChaser went down. I think one of the results was, and continues to be, a power struggle, even though not all the APS people are or were Canadian.

Far as I know, TBX never was under the APS umbrella. The domain was registered in May 2010. The SEC brought litigation against Ryan and PSC on 29 June 2010. In all likelihood, his assets had been frozen before then; I imagine his old associates were aware of that.

I've followed most of the APS plays beginning with Alphatrade in the summer of 2010; as far as I can recall, TBX was never part of them.

And neither TBX nor Paolucci was involved in the first APS lawsuit: the one from 2010, with Nguyen, Fung, Sepe and Thompson as plaintiffs.
