No question that it is "possible", and I REALLY hope that it happens, but it's what the judge might think along the way that worries me some.

Imagine a scenario where the judge has Lucent's arm twisted far enough to make them say "uncle" on the Tantivy claims, and then the judge hears IDCC say "That's not good enough yet judge. Keep twisting on those Tantivy claims until we hear them say "uncle" on ALL of OUR patents."

My concern is that some judges might take offense at being "leveraged" in that way unless everything had been put on the table and agreed beforehand.
