Knowledge of insider information is not illegal. Financially profiting based on knowledge of insider information is. If an insider such as Evan was to show someone undisclosed upcoming financials that would be considered insider information. But if Evan said something like as we said before, we are still on target for profitability in late 2012, that wouldn't be considered insider information. I’m not asking Gary for undisclosed material information but he can get a good feel of how things going from the look of the show room, are people acting upbeat, etc.
Material insider Information is information which would be likely to affect a stock's price once it becomes known to the public. Examples include a takeover, a divestiture, significant management changes, and new product introductions. This is also called material news.
