My interpretation is that the charges are being pressed by Jorge through his personal attorney. What I understand about the law in Chile is that a plaintiff can proceed on his/her own with criminal charges.

Contrary to the (misleading) MSX press release, the presumption of the courts is that the defendants are innocent unless proven guilty... and I don't see how it could be otherwise in a system that allows charges to be laid by private attorneys. Despite what someone else wrote about the defendants being required to present proof of innocence on "THAT DAY ALONE" the Sept 5th hearing is more along the lines of a preliminary hearing - the beginning of a process with many stages.

The long and the short of it, don't get too excited over what's going to happen this week. Unless there's a deal, it's likely to take some time to resolve.
