Mark Kay told me they were aware of the Authentify patent suit and reitterated that their patent had been upheld and predated the Authentify patent for OOB. He said that Authentify was nervous about the situation and that the our lawyers were already working on it. Mark said this has made potential customers call Strikeforce as they do not want to risk being shutdown by a patent suit much like Samsung has been on some phones.

I just wonder if Authentify has a distinct difference that they see as being outside the SFOR OOB patent. Otherwise, they are setting the table for SFOR by settling with the other companies. If they are found to violate Strikeforces patent then by default all of the other companies that settled with Authentify would also be guilty. Any of the revenue flowing in from the settlements would then be due to Strikeforce with a nice penalty for Authentify to pay!!

This is not going to be settled overnight. I am not counting on revenue from lawsuits as a premise for my investment in SFOR, that will all be gravy.
