It sounds like it shouldn't be right, but that's just how right of first refusal works, and how it's written into their contract, unfortunately.

When it comes to the IP Apple already licensed, Apple can keep LMT from selling further CE IP licenses. But for other products, fields of innovation, etc, Apple only gets the right to just buy the license first and keep the other business from buying. If Apple doesn't buy it, then LMT can do business as they choose with it.
