If IDCC wins a confirmation of the final arbitration award and Nok loses its motion to vacate or modify, any efforts to appeal the rulings of the NY fed judge by Nok will be defended by IDCC. IDCC will then seek additional damages stating that Nok is using the system strictly for delay in performing its duties and obligations under the PLA as defined by the parties and interpreted in the final award issued by the ICC in accordance with the future dispute agreements contained in said PLA and the documents executed by Nok upon its application for said binding arbitration with the ICC.
