In my experience, the fact that no hearing is set makes it LESS likely that the Motion will be granted. If the Court were inclined to grant the motion - an order that is subject to immediate appeal since it is a final judgment - it is my belief that the Court would take every step it could to protect the judgment from being reversed. Once such step is to hold a hearing to create a full factual and legal record.
