You're reading it incorrectly. That is the definition of a non-Major Competitor that does NOT compel Nokia to pay a royalty rate. Nokia can choose to select an entity meeting that definition as an MFL, but cannot be compelled (under what's redacted here) to follow the terms of someone who meets those terms but is not a major competitor.

The specific triggers are the major competitors - a term that is not defined for us here.
