Is it possible that JMW could approve confermation but judge the releases non binding??

I would say that since TPS was left out of the mediation they did not know whatever they were told today.Once they were told the info we can only guess at they wanted in. That is a pretty good sign there is some invisible asset or outcome that would be worth the amount that TPS hoped to gain
