1) "other infringers ...have guarantee protection from ICM...
I'm not a lawyer, but my reading is that ICM has offered an indemnity to the other "infringers". AS with an insurance policy, this indemnity only pays out IF the indemnifier considers it within the terms of the agreement AND they have the funds to do so. This agreement cannot change the liability of the "infringers" resulting from any successful law suit against them. Hence if ICM refused, or did not have the resources, to pay a settlement, the "infringers" would still have to ante up.
2) I believe that the future of GERS is no longer tied to successful settlement of the law suit. They are beginning to generate sufficient free cash flow to meet their liabilities and pay back debt. Hence the threat of R/S is receding by the week imo.
