I doubt it, as FDA will only ask for information when they need it. It's also not practice for FDA to 'delay' based on anxious company representatives. This isn't a waiter spitting in your food because you're rude to him.
No it is not, and coupled with the obvioius dilution, it can be looked at as no ruling has yet to be made....because if it was, then BIEL would be in blantant and obvious violation of SEC rules by trading on material information without making it public.
