Just to add to your #3....it would be a total conflict of interest for the CEO of a company to join the board of a direct competitor. Among the various documents Goldfarb most likely signed when he became CEO of Atrinsic, I am sure one of them was some form of a non-compete/non-disclosure.

Now, if the two companies are becoming one, this would change things a little bit.

Ahhhh the speculation continues.........
