HOWREY TEAMS WINS $61 MILLION JURY VERDICT ON BEHALF OF CLIENT

Howrey Simon Arnold & White LLP, has announced that a team of attorneys led by Howrey partner Henry Bunsow of the firm’s San Francisco office, teamed with Fulbright & Jaworksi partner Brett Govett of Dallas, and Denise M. DeMory of DeMory & Grigg of San Francisco, to win a $61 million jury award and a finding of willful infringement for their client, Harris Corporation of Melbourne, Florida in a patent infringement case against Ericsson, Inc. The jury rendered a verdict in Harris v. Ericsson, October 29, 2002, in the United States Federal District Court for the Northern District of Texas.

The patent relates to cellular communications systems and methods that are used to equalize transmitted information in cellular phones and base stations. Harris charged Ericsson's GSM, TDMA and ADC mobile phones and base stations with infringement.

After a two-week jury trial, the jury found that Ericsson's cellular phones and cellular base stations infringe four claims of Harris' United States Patent No. 4,365,338 for digital transmissions over a dynamic dispersion channel. The jury awarded Harris approximately $61 million in compensatory damages and found that Ericsson's conduct was "willful." Based on that finding of “willful conduct” the District Court can increase the award up to three times and award attorneys’ fees.

Bunsow recently joined Howrey’s San Francisco office. The Howrey team included Alan Fisch, Terry Corbin, Jennifer Sklenar, Jason Hoffman, Matt Hocker, Jayna Whitt, Heather Fan, Erin Walsh, Ken Ragsac, Susan Crane, Dawn Edberg, Sharon Sotelo, Maria Li and Annette Pray.
