I think I can make a pretty good guess as to what that is about. There was a behind-closed-doors argument about it among the members of the EC. They compromised, and when you compromise behind close doors, everyone walks out of the room and publicly supports the compromise. They agreed to publicly support the compromise, even if the EC pref holders were not happy about it. So part of the compromise was: this will only be a proposal, if the judge wants to change it we will allow that, and provide for that possibility. They punted the final decision to the judge.

The EC wants the POR as a whole to pass, but they are giving only lukewarm - almost half-hearted - lip service as to the specific issue of the 70/30.
