2012 Suggestion to Shareholders: Petition Judge Sleet -


Let's face facts. This case was changed by three committed shareholders: (1) Joyce Presnall; (2) Nate Thoma; and (3) the shareholder known as 'Observer'.

I believe that it is within the power of WMI shareholders to change this case by staying confirmation until the two critical appeals are decided. I am not an activist in my 'real' life, but this plan, which the EC says was the best it could deliver after 'fair and reasonable' and the TPS decision, unlike the Nate and Joyce moments of the past, does not have shareholder fingerprints on it, and since we have to live with the consequences, I would prefer that it did.

I am not a litigator and do not practice in the federal courts. However, I believe that most of the positive change in this country has come from activism, and if anything calls for action, it's WMI shareholder interests at this most critical stage. All we'd be requesting is expeditious review of the pending WMI appeals: we would not be telling the court how to rule.

My suggestion is that the shareholders create a petition (I'm willing to do this) to Fedex to Judge Sleet asking him to: (1) expedite both the TPS and EC appeals; (2) consolidate them; and (3) stay the confirmation pending resolution of those appeals.

Such a petition would not interfere with his judicial neutrality in MAKING his decision. All the shareholders would be doing is saying: "These appeals are important to us and our families. The backlog preventing the adjudication of these appeals is constitutionally indefensible. Please halt the confirmation and expedite the appeals."

More than anyone else, JPM and the FDIC want POR7 confirmed -- asap. Why help these parties who have done so much to hurt us? Let us join together to importune Judge Sleet to stay confirmation and adjudicate these claims. I don't think there's anything better we could do for ourselves at this point.

I'll draft the text, and if Lawrence Meany will agree to set up the petition site and Fedex a written version of the petition to Judge Sleet (with a cc to appellants (the EC and TPS)), we're in business. We've also got to be willing to converge on Delaware and picket at least one day.
