It would more likely be the presence or absence of side effects; i.e. pain, swelling, itching, redness, etc. We're talking about a very low energy output - lower than other devices that have been extensively studied and found to be safe from side effects.
You can only test so much. At some point, you have to say it's 'safe' for it's indicated use. Anything out side of that use, therefore, is unsafe. That includes using it not as prescribed, which is why there is a warning label on everything.
FDA can clear and approve drugs safe for intended use...they cannot and do not protect people from themselves and their inherent ignorance.
