Loop: Is it to our benefit if the judge throws the case out. If the case is heard and resolved in IDCC"s favor is that better?

I believe you are correct in your analysis of IDCC and its potential financial return. However, in almost all cases your logical speculations on the future actions of Nokia or the courts have not come to pass. It makes you lose faith in the integrity of the system. If the ICC ruling does not stand it would certainly tarnish its reputation as a resolver of disputes.
