Inquiry into California's Role in CAFE Standards Launched
Republican Rep. Darrell Issa says state board may have taken on unauthorized role in setting regulations.

Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee, has launched an inquiry to determine if the California Air Resources Board (CARB) exerted influence "outside the scope of law" over the setting of the next round of the Corporate Average Fuel Economy (CAFE) standards. The state board is tasked with regulating greenhouse-gas emissions, while the authority to set national CAFE standards is delegated by Congress exclusively to the National Highway Traffic Safety Administration.

A state board representative said that in the lead-up to the 2017-2025 standards ruling, the board, NHTSA and the Environmental Protection Agency “shared data, conducted joint technical and engineering studies and had regular staff meetings” as part of a unified program. Issa suggested that the functional difference between regulating tailpipe emissions and fuel-economy standards was negligible, saying in a letter to the board, "It appears that CARB and the state of California are in the business of regulating fuel-economy standards, in direct contravention of the law.”
