Here's a thought, remember how Rosen has always downplayed the NOL's whenever the subject came up? Even when recently asked by the THJMW, he balked and played dumb about the benefit of 2012 vs 2011 tax returns? Well, did you notice his slight sense of urgency in the latest hearing when he stated that if mediation was fruitful, the confirmation would need to take place asap in 2012 because of recent changes to the tax code! I just found this quite ironic for somebody that played so dumb all along when the topic came up! And no, I am not surprised!
Another point that is hardly, if ever mentioned:
Recall the sense of urgency on the part of this RAT to try to get the Confirmation rushed through back at the very END of December 2010? Right at the time when doing so would have caused most of the "important" NOL's (i.e., the ones that are unrestricted), to completely EVAPORATE?! Right when WMI would only keep 1/365 of the unrestricted NOL's!
He would have forced an Opinion to be rendered right on the eve of December 31, 2010, if he could done so (and in fact did everything he could to try to get JMW to render one), and would have put a gun to her head if he thought he could get away with it.
And recall JMW's response that she would NOT issue her Opinion until AFTER January 1, 2011.
RosenRAT is one sneaky, tricky, deceitful POS, and I think that JMW is onto his games (more so than she lets on).
When she called B.S. on him at the recent hearing, he FLAT OUT LIED TO HER and claimed that there would be absolutely NO difference in the unrestricted NOL's in 2011 versus 2012 . . . and then said "we'll get an answer to you before the end of the hearing" and never did until this week . . . and even then, he changed the answer to something that she NEVER asked him, never admitting that he DELIBERATELY LIED TO HER!
You need to watch out for this one - he's a tricky, sneaky, coniving POS.
Oh, and I kinda get the impression that he would sort of like to torpedo Equity, if he had any say in the matter. But that's just a hunch I have.
