According to this and other articles the EC is investigating both Samsung and Apple regarding their use of patents, not just Samsung.

EC investigating Apple, Samsung over antitrust concerns

updated 11:30 am EDT, Fri November 4, 2011
One or more may be accused of abusing patents

Regulators from the European Commission are investigating both Apple and Samsung over possible violations of EU antitrust rules, according to Reuters. At the root of the issue are mobile phone patents. "The Commission has indeed sent requests for information to Apple and Samsung concerning the enforcement of standards-essential patents in the mobile telephony sector," the EU executive says. "Such requests for information are standard procedure in antitrust investigations to allow the Commission to establish the relevant facts in a case. We have no other comments at this stage."

The news puts a twist on an earlier report, which mentioned only Samsung as the target of a Commission probe over possible anti-competitive behavior. The Reuters piece explicitly states however that Apple is also under scrutiny. In media commentary, both companies have sometimes been accused of abusing patent lawsuits to fight for control of the market.
