The OEMs are undoubtedly being told in no uncertain terms that speaking out against INTC will be a kiss of death for them.

Are you crazy? Intel wouldn't dare. The OEMs would record them, hand the material to AMD and the court, and perhaps threaten to issue an immediate PR concerning the threat, thereby tanking Intel's stock as the world sees the evidence add up.
