re your #1 -- These provisions are known as 'most favored licensee' clauses; MOT is not a licensee -- that may sound like a flip response, but it isn't. Also, I believe it is generally true that such a clause in a given license agreement only refers to other licenses which post-date such license agreement (note, for example, that the Samsung agreement pre-dated the NOK agreement . . .). Further, a license from IDCC for its 2G IPRs covers all of IDCCs 2G IPRs; the MOT case only involved a few of IDCC's 2G IPR claims (and recall that IDCC has grown its base of 2G IPRs very considerably since the MOT case).
