I don't think insurance applies here. Since it is a well-known fact that the legal costs of trying to open a new mine in the United States is millions of dollars, you would have to find a very stupid or naive underwriter to write that policy.
Especially in a difficult State such as Montana and where a connected environmental group have already publicly stated their intention to fight that mine.
I don't know of a single mining company anywhere with legal insurance that covers environmental challenges at the permitting stage. Insurance at the operating stage is a different matter.
