IMO, this perhaps depends on the chronological order of the event. If they were under the patent application process, it was not in their control of the outcome in most cases. However, my question to you would be if they need to have patents or intellectual property to get into an agreement. Evidently, Pulsar received an award for innovation in 2005 on microwave tankless water heater.
