Mike Nessen is just as guilty or innocent as Dean Janes. If they are guilty, that makes him a huckster, lying, cheating, stealer just like Dean. The only difference is he was the Penny Stock PR man, not the Penny Stock CEO or Carnival Barker (since he didnt say much)!
