With regard to the patent issue, I seriously doubt anyone knows how this will play out. It is simply wrong to say the patent office "trumps" everything. What trumps everything is the legal documents that the parties hold. All the patent office does is record what it is given with regard to assignments. It has no idea what other legal documents are out there that may define the rights in the patent.
