I don't think he got the go ahead to issue shares. The way it was worded in the PR made it seem that way, but I doubt the Judge allowed him to issue new shares. I could be wrong here, but it seems he worded it to create maximum panic to induce a sell off, and he needed to make it sound like new shares would be issued to screw up the share exchange.
