There are minimum amounts due to ERFW by SLB under the Agreement. However, since a default occurred (the cause and nature of which is in dispute), no payments to ERFW are "guaranteed." The arbitrator (usually a retired judge) in binding arbitration will deterimine what, if any, amounts are owned to ERFW. It could be nothing. It is either extremely naive or disingenuous of Cubley to claim that ERFW is guaranteed payment by SLB. That is only his hope. The arbitrator and SLB might feel very differently.
