Just my opinion:
If I were a large company as those who JB is targeting I would want to have JBII to have the final permit in hand from the DEC and not just the consent order before signing on the bottom line.

I also feel JB thought he would have already gotten the permit long before todays date and that is why he said before the end of April we would see the LOI signed and delivered.
I have been wrong many many times.
It is just logical to me.

Once we get that permit it is off to the races, and all will fall into place.
